Mindful Pathways Support respects your privacy and takes care with the personal information you share with us.
This Privacy Policy explains what information we collect, why we collect it, how we use and protect it, and the choices you have about your information.
We handle personal information in accordance with applicable Australian privacy law, including the Privacy Act 1988 and the Australian Privacy Principles.
The information we collect depends on your relationship with Mindful Pathways Support.
It may include:
your name, contact details, date of birth and emergency contacts
information about your disability, health, support needs, communication preferences and goals
NDIS and funding information needed to arrange or provide support
information contained in referrals, support plans, assessments or other documents provided to us
records about the support we provide, including progress notes and agreed strategies
billing, payment and administrative information
feedback, complaints, incidents or other communications with us.
We may also collect information about family members, nominees, guardians, Support Coordinators, allied health professionals and other people involved in a participant’s support.
Some of this information is sensitive information, including health and disability information. We take additional care when collecting and handling it.
Where practical, we collect information directly from you.
This may happen when you:
contact us by phone, email or through our website
make an enquiry or send a referral
complete an intake or service agreement
speak with us about your support
receive support from a Mindful Pathways Support worker.
With appropriate consent, we may also receive information from a parent or guardian, nominee, Support Coordinator, allied health professional, plan manager or another person involved in your support.
There may also be circumstances where information is collected or disclosed without consent because this is required or permitted by law.
We collect and use personal information so we can understand what support is needed and provide that support safely and appropriately.
This may include using information to:
respond to enquiries and referrals
arrange, plan and provide disability support
communicate with you and the people you have authorised
work alongside your wider support team where consent has been provided
manage bookings, rosters, payments and service records
respond to feedback, complaints, incidents and safety concerns
meet our legal, regulatory and NDIS provider obligations.
We only collect information that is reasonably necessary for our work.
We do not share personal information simply because someone asks for it.
Information may be shared with people involved in providing or managing your support when you have given consent, or where sharing is otherwise permitted or required by law.
This may include:
Mindful Pathways Support workers and authorised team members
a family member, nominee, guardian or representative you have authorised
Support Coordinators, plan managers and allied health professionals
the NDIA or NDIS Quality and Safeguards Commission where relevant
professional advisers or service providers that help us operate our organisation
emergency services, government agencies or other authorities where required or authorised by law.
Where possible, we will explain why information needs to be shared and who it will be shared with.
You can also speak with us about changing or withdrawing consent. There may be some information we are still required to keep or disclose by law.
Personal information may be held electronically or, where necessary, in physical records.
We take reasonable steps to protect information from loss, misuse, interference, unauthorised access, modification or disclosure.
Access to participant information is limited to people who need it for their role. We also use appropriate processes for storing, accessing, transferring, retaining and securely disposing of records.
No method of electronic storage or communication can be guaranteed to be completely secure, but we take privacy and information security seriously.
Some technology or service providers used by Mindful Pathways Support may store or process information outside Australia.
Where personal information is disclosed overseas, we take reasonable steps to ensure it is handled appropriately and in accordance with applicable privacy requirements.
When you use our website, some technical information may be collected automatically. This can include your IP address, browser or device information, pages visited and the time of your visit.
Our website may use cookies or similar technologies to help the site work properly, understand how it is being used and improve the website.

Information you submit through an enquiry, referral or contact form will be handled in accordance with this Privacy Policy.
You can ask to access personal information we hold about you or ask us to correct information that is inaccurate, incomplete or out of date.
We may need to confirm your identity before providing access.
We will respond within a reasonable period and will explain if there is a lawful reason we cannot provide access to particular information or make a requested correction.
You can also ask for information in a different format where reasonably practicable.

Tell us what has happened and what you would like us to look into. We will review the concern and respond as soon as reasonably practicable.
If you are not satisfied with our response, or we have not responded within 30 days, you may be able to make a complaint to the Office of the Australian Information Commissioner.
If your concern relates to the provision of NDIS supports or services, you may also contact the NDIS Quality and Safeguards Commission.
If personal information is lost, accessed or disclosed without authorisation, we will assess what has happened and take appropriate steps to reduce the risk of harm.
Where a data breach is required to be notified under the Notifiable Data Breaches scheme, we will notify affected individuals and the Office of the Australian Information Commissioner as required by law.
We keep personal information for as long as it is reasonably needed to provide our services, manage our organisation and meet our legal and regulatory obligations.
When information is no longer required to be kept, we take reasonable steps to securely destroy it or permanently de-identify it.
Mindful Pathways Support provides support to children and young people as well as adults.
When collecting or using information about a child or young person, we take their age, understanding, circumstances and any authorised parent, guardian or representative into account.
We aim to explain privacy and information sharing in a way the person can understand.
We may update this Privacy Policy when our services, systems or legal obligations change.
